Good initial analysis at http://www.dailykos.com/story/2007/9/26/19507/6639

From the opinion, per AP:
"For over 200 years, this Nation has adhered to the rule of law - with unparalleled success. A shift to a Nation based on extra-constitutional authority is prohibited, as well as ill-advised," she wrote.

By asking her to dismiss Mayfield's lawsuit, the judge said, the U.S. attorney general's office was "asking this court to, in essence, amend the Bill of Rights, by giving it an interpretation that would deprive it of any real meaning. This court declines to do so."
It will, of course, be appealed by our anti-constitutional government.

That judge needs to learn some sarcasm, if she wants to get her points across better. Seriously, I don’t think I could have written something that wasn’t either sarcastic or vituperative.

I read it as an overwhelmingly sarcastic response to Bush's cries about 'activist judges'.

No, sarcasm would be like, ‘I would like to agree with you, but your reasoning is so intricately constructed that a dummy like I cannot fathom it.’

Much better: ‘I would like to agree with you, but your reasoning is so sophisticated that I am not up to the task.’
